KCBS Accident Waiver and Release of Liability

IN CONNECTION WITH MY REGISTRATION FOR THE SANCTIONED CONTEST, PRIOR TO MY PARTICIPATION IN THE SANCTIONED CONTEST, I ACKNOWLEDGE THIS STANDARD ACCIDENT WAIVER AND RELEASE OF LIABILITY MUST BE AGREED UPON AND ACCEPTED BY ME.  THIS WAIVER CANNOT BE ALTERED, EXCEPT WITH PRIOR WRITTEN PERMISSION FROM KANSAS CITY BARBEQUE SOCIETY. 
I acknowledge the sanctioned contest (the “Sanctioned Contest”) that I am registering to participate in (as a team member, head cook, attendee, volunteer, spectator or otherwise) carries with it the potential for serious injury and property loss, whether such risks are apparent to me or not (including any risks that may arise from negligence or carelessness on the part of any of the KCBS Released Parties (as defined below)).  The risks include, but are not limited to, those caused by equipment and actions of other people, including, but not limited to, participants, volunteers, spectators and Sanctioned Contest officials. I (for myself, my executors, administrators, heirs, next of kin, successors, and assigns) (the “Releasing Parties”) agree to the following:   
I, for myself and the other Releasing Parties, (a) knowingly and voluntarily waive, release and forever discharge from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter occur to me arising from my participation in the Sanctioned Contest, including, without limitation, my traveling to and from the Sanctioned Contest, THE FOLLOWING ENTITIES OR PERSONS:  KCBS, its directors, officers, employees, volunteers, representatives, and agents (collectively, the “KCBS Released Parties,” or each individually, a “KCBS Released Party”); and (b) indemnify, hold harmless and promise not to sue any KCBS Released Party for any liability for insurance, damages, costs or losses resulting from, or arising out of, the Sanctioned Contest, whether caused by the negligent act or omission of any KCBS Released Party.  I acknowledge the KCBS Released Parties are NOT responsible for the errors, omissions, acts, or failures to act of any third party conducting any function at the Sanctioned Contest. 
I consent to receive medical treatment which may be deemed advisable in the event of injury, accident and/or illness during the Sanctioned Contest.  I understand at the Sanctioned Contest I may be photographed, and I agree to allow my photo, video or film likeness to be used for any legitimate purpose by KCBS.
This Waiver will be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.  I acknowledge I have carefully read this Standard Accident Waiver and Release of Liability (this “Waiver”) and have the legal capacity to agree and accept this Waiver.   I fully understand by agreeing to and accepting this Waiver, I am irrevocably waiving certain legal rights that might otherwise be available to me and/or any of the other KCBS Released Parties, including, but not limited to, any claim or liability caused by negligence.
I HAVE CAREFULLY READ THIS WAIVER AND I FULLY UNDERSTAND ITS CONTENT. I AM FULLY AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT, AND I FULLY UNDERSTAND THAT BY CHECKING THE BOX OR CLICKING I AGREE, I AM AGREEING TO BE BOUND BY ALL OF THE TERMS SET FORTH IN THIS WAIVER.
